D/L771 27.08.2026 Bpg. C.R.M. (NDPS)1770 of 2026 In Re: An application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Hili Police Station Case No.91 of 2025 dated 28.04.2025 under Sections 20(b)(ii)(c)/27A/28 of the Narcotic Drugs and Psychotropic Substances Act, 1985; Kajali Mahato @ Kajali Mahata Versus The State of West Bengal Mr. Kaushik Choudhury Mr. Dwaipayan Panda. …for the petitioner. Mr. Satadru Lahiri Ms. Pramita Banerjee. …for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody since 11.05.2026. There is no possibility of the trial being taken to its logical conclusion. As such, the petitioner be released on bail. Learned advocate for the State opposes the prayer for bail and submits that initially there was recovery of 93.4 kgs. of ganja and subsequently another 2.64 kgs of ganja were recovered from the present petitioner. Report submitted by the State reflects that there are two other cases against the petitioner being Hili Police Station Case No.108 of 2022 and Hili Police Station Case No.109 of 2018. The last of the case refers under NDPS Act. Having considered the 2 petitioner being a repeat offender, I am not inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner in CRM(NDPS)1770 of 2026 is rejected. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
