27.08.2026 Court No.35. D/L.784. Rakib (Allowed)
CRM (NDPS) 1783 of 2026
In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliachak Police Station case no. 64 of 2026 dated 13.01.2026 under Sections 21(c)/27A/29 of the NDPS Act.
And In the matter of : Salam Sk. @ Salem Sk.
……Petitioner. Mr. Mritunjoy Chaterjee Mrs. Suchismita Chakraborty Mr. Debarnab Adhikary
.....for the Petitioner. Mr. Anindya Ghosh Mr. Pronojit Roy
……for the State.
Learned advocate appearing for the petitioner submits that petitioner is similarly placed as other accused person namely, Md. Asmaul Khan who was granted bail in CRM (NDPS) 1298 of 2026. Learned advocate appearing for the State opposes the prayer for bail. I have taken into account that petitioner is similarly placed as other accused and charge-sheet has already been submitted. Police reports do not reflect any previous antecedents. Having considered the same, I direct the learned Special Court to release the present petitioner namely, Salam Sk. @ Salem Sk. on same terms and conditions as was imposed upon Md. Asmaul Khan in CRM (NDPS) 1298 of 2026. Thus, CRM (NDPS) No. 1783 of 2026 is allowed.
2 Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
