ORAL ORDER
1. Accused in Crime No.367/2026 registered by Hebbagodi Police Station, Bengaluru City, for the offences punishable under Sections 69, 88 of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail.
2. Heard the learned Counsel for the parties.
3. FIR in Crime No.367/2026 was registered by Hebbagodi Police Station, Bengaluru City, for the aforesaid offences against the petitioner herein based on the first information dated 14.07.2026 received from the alleged victim lady aged about 26 years. In the said case, petitioner was arrested on 14.07.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.5363/2026 was rejected on 25.07.2026. Therefore, petitioner is before this Court.

4. A reading of the first information submitted by the alleged victim lady would go to show that she got acquainted with the petitioner in the month of December 2022, and thereafter, they started loving each other. In the month of February 2023, petitioner allegedly had taken the victim lady to a hotel and had sexual intercourse with her with a promise to marry her. Subsequently, they had sexual intercourse multiple times and as a result, she had conceived twice. Her pregnancy was aborted after she had consumed tablets given by the petitioner. It is alleged that in the month of March 2026, when the victim insisted the petitioner to marry her, he brought to her notice that he is already married and showed her his marriage photographs which was in his mobile phone. Subsequently, the victim lady approached the police on 14.07.2026 and submitted the first information, based on which, FIR was registered against the petitioner.

Learned Counsel for the petitioner has produced the marriage invitation card of the petitioner to show that his marriage was solemnized on 20.06.2026. Petitioner and the victim girl were in relationship for a considerable period of time.

Petitioner is now married to some other lady and after coming to know about the same, the alleged victim has approached the police. Considering the aforesaid aspects of the matter and the nature of allegations found against the petitioner with whom the victim had relationship for a period of more than three years, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order:
6. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.367/2026 registered by Hebbagodi Police Station, Bengaluru City, for the offences punishable under Sections 69, 88 of BNS, 2023, subject to the following conditions:
a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;

c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed off.
