Ms. Shyanti Poddar Mr. Suman Agarwal. …for the State. Learned advocate appearing for the petitioner submits that the petitioner is innocent and has been foisted with a criminal case. Charge-sheet has been submitted and the materials therein only implicate the petitioner as he happens to be husband of the complainant. Learned advocate for the State has produced the case diary. The Memo of Evidence submitted by the State reflects that charge-sheet has been submitted. Case diary do not reflect medical reports relating to accusations under Section 313 of the Indian Penal Code. Having regard to the same, I am of the opinion that custodial detention of the present petitioner at this stage may 2 not be warranted. As such, the prayer for anticipatory bail of the petitioner is allowed. Accordingly, in the event of arrest, the petitioner, namely, Rafikul Alam shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the charge-sheet has already been submitted before the jurisdictional court, this order of anticipatory bail will remain valid for a period of six weeks from date. Thus, CRM(A)2609 of 2026 is allowed. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
