1. Affidavit of service filed in Court today is taken on record.
2. The petitioner’s application seeking transfer on the ground of distance has been rejected by the head of the institution on 8th April, 2022 with the remark that the petitioner did not fall within the 10% of the limit of teachers eligible for transfer.
3. Nearly four years have elapsed from the date when the application of the petitioner stood rejected. There may have been a change in the staff strength of the school in the meantime.
4. In view of the above, the instant writ petition stands disposed of with the observation that it will be open for the petitioner to make fresh application
2 seeking transfer in the prescribed format disclosing the ground for the same.
5. If such application is made, the same shall be considered by the head of the institution strictly in according with the prevailing transfer Rules at the earliest but positively within a period of eight weeks from the date of making the application.
6. If the application of the petitioner is allowed, then necessary consequential steps shall be taken by the school authority.
7. Suspension of Utsashree portal will not stand in the way of the respondent authorities from considering the application filed by the petitioner.
8. The writ petition stands disposed of.
9. Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
