ORAL ORDER
1. Accused No.3 in Crime No.124/2026 registered by Siddapura Police Station, Bengaluru, for the offences punishable under Sections 109(1), 118(1) read with Section 3(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.124/2026 was registered by Siddapura Police Station, Bengaluru, for the aforesaid offences against Sadiq and others based on the first information dated 03.06.2026 received from Syed Waseem, who is one of the injured victim in the present case. During the course of investigation, the petitioner was arrested on 07.06.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.5625/2026 was rejected on 24.06.2026. Therefore, he is before this Court. 4. In the first information dated 03.06.2026, it is stated that on 02.06.2026 at about 08.00 p.m. when first informant and his friend Jameer were walking on the road side, they found

that accused No.1 and one Amjad were quarrelling. First informant allegedly tried to intervene and therefore, accused No.1 assaulted him. First informant in turn had assaulted accused No.1 - Sadik and therefore, Sadik had vengeance against him. Subsequently at about 02.30 a.m. on 03.06.2026, Sadik along with his friends confronted the first informant and after abusing him assaulted him with weapons and caused injuries. The allegation of assaulting first informant with knife is found in the first information as against accused No.2 – Saif. There is no allegation against the petitioner in the first information about he assaulting the first informant and his friends with any weapon. He is in custody in the present case from 07.06.2026 onwards. Major portion of the investigation is completed. Accused Nos.1 to 3 have been already arrested in the present case. Petitioner has no other criminal antecedents. Accordingly, the following order:-

The petitioner is directed to be enlarged on bail in Crime No.124/2026 registered by Siddapura Police Station, Bengaluru, for the offences punishable under

Sections 109(1), 118(1) read with Section 3(5) of BNS, 2023, subject to the following conditions:
a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed off.
