D/L252 27.08.2026 Bpg. C.R.M. (M) 1433 of 2026 In Re: An application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Jamuria Police Station Case No.122 of 2026 dated 03.04.2026 under Sections 64(2)(m)/351(3) of the Bharatiya Nyaya Sanhita; Rupan Baskey Versus The State of West Bengal& Anr. Mr. Ayan Bhattacherjee Mr. Sekhar Mukherjee Mr. Anindya Chowdhury Mr. Subhajit Mukherjee Ms. Ishita Kundu. ...for the petitioner. Mr. Gournaga Kumar Das Ms. Anushka Ghosh. …for the State. Ms. Sibangi Chattopadhyay Mr. Sourav Mondal Ms. Indrani Das. …for the de facto complainant. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 4 months. Charge- sheet has already been submitted, charges have been framed and witness action has just commenced. Learned advocate for the de facto complainant opposes the prayer for bail and submits that the victim has been allured and deceptively ravished. Learned APP produces the case diary and draws the 2 attention of the Court to the statement of the victim under Section 183 of the BNSS. Having considered that the petitioner was a priest against whom serious accusation has been made, at this stage, I am not inclined to release the petitioner on bail after inspecting the incriminating materials available in the case diary. As such, the prayer for bail of the petitioner is rejected. Petitioner will renew his prayer for bail after the evidence of the victim is over. At this stage, CRM(M)1433 of 2026 is dismissed. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
