JUSTICE D K SINGH) The present Intra Court Appeal has been filed impugning the order dated 19.02.2024 passed by the Writ Court in Writ Petition No.27850/2018 whereby, the Writ Court allowed the Writ Petition setting aside the award dated 31.10.2017 passed by the Labour Court in Ref.No.13/2015. 2. On the last date of hearing i.e., on 14.08.2026 with a view to give quietus to the dispute, we requested Sri. Somashekar, learned counsel for the appellant to convince the appellant –Management to pay Rs.5,00,000/- to the respondent towards the full and final settlement of - 3 - HC-KAR CNR: KAHC010196852024 NC: 2026:KHC:44662-DB WA No. 518 of 2024 all his dues, claims, entitlements and rights arising out of the dispute. 3. Learned counsel Sri. Somashekar appearing for the appellant submits that Management has agreed to pay Rs.5,00,000/- to the respondent in full and final settlement, so as to give quietus to the dispute. 4. The respondent Sri. Annegowda is present in the Court. He states that he accepts the aforesaid offer made by the appellant-Management. 5. Considering the aforesaid facts, we set aside the impugned judgment and order passed by the learned Single Judge. the appeal is accordingly allowed, subject to the appellant-Management making payment of a sum of Rs.5,00,000/- to the respondent within a period of two weeks from today. 6. The respondent is entitled to withdraw the deposited amount of Rs.2,25,103/- along with the accrued - 4 - HC-KAR CNR: KAHC010196852024 NC: 2026:KHC:44662-DB WA No. 518 of 2024 interest thereon, deposited by the appellant-Management before the Assistant Labour Commissioner on 01.08.2012. 7. The respondent further be entitled to withdraw the Provident Fund contribution by the appellant- Management along with his contribution, in accordance with law. Ordered accordingly.
