1. Affidavit-of-service filed on behalf of petitioners is taken on record.
2. At the outset, learned advocate representing petitioners submits that prayers made for registration of FIR and removal of unauthorized obstruction are not pressed. However, prayer thereby directing concerned police authorities to provide assistance which would enable petitioners to make construction is pressed.
3. Having heard learned advocates representing petitioners, respondent no.10 and State respondents, this Court finds that issue which is canvassed in this writ petition is in spite of granting permission by the concerned local authority petitioners find it difficult to make construction requiring intervention of the police authorities.
4. If petitioners are obstructed from making construction
in that event approach has to be made before concerned local authority.
5. Police authority is not appropriate authority to decide whether petitioners have unfettered right to make construction based on sanction plan.
6. Hence, present writ petition is not interfered with and same stands dismissed.
7. However, this order shall not preclude petitioners to approach appropriate authority/forum in pursuit of remedy.
