1. Review of this Court’s order dated 28th July, 2025 is sought on the ground that in respect of similar orders passed in F.M.A. 1002 of 2024 vide order dated 21st August, 2025, the Principal Secretary, Finance Department, Government of West Bengal was added as party respondent and a similar direction is sought in the instant proceedings. 2. It is submitted that based on an earlier order passed by another Division Bench, the State is bearing 40% of the dues of the Municipality towards pension to be paid to retired employees. 3. This Court, however, notes that even 60% of the terminal dues payable to their employees required to be borne by the Municipality is not being paid. Nabadwip Municipality, which is one of the oldest Municipalities in this country, just does not have funds. 2
4. This Court, however, notes that the State is a party respondent to the appeal. 5. In that view of the matter, this Court is not inclined to entertain the review application on the above score. There is no error apparent on the face of record or any new evidence produced by the Municipality for reviewing the order dated 28th July,
2025. 6. R.V.W. 293 of 2025 fails and is hereby dismissed. 7. In view of dismissal of the review itself, the connected application being CAN 1 of 2025 shall stand dismissed. 8. There will be no order as to costs. Re: CPAN 997 of 2026

Having regard to the observations of this Court in R.V.W. 293 of 2025 contained in this Court’s order dated 27th August, 2026, this Court directs the Principal Secretary, Finance Department, Government of West Bengal to be impleaded as a party respondent in the contempt application. 10. The learned Advocate-on-record of the applicant shall carry out amendments in the cause title and cause service on the newly added respondent. 11. A copy of the instant contempt application has been served upon Mr. Majumdar, learned Counsel appearing for the Nabadwip Municipality. 3

The Principal Secretary, Finance Department, Government of West Bengal may be represented on the adjourned date through his learned Advocate. 13. Let appropriate instructions be taken and be placed before this Court on the adjourned date. 14. List the matter on 3rd September, 2026 under the same heading. 15.
