…..for the State. 1. It is submitted by the learned advocate for the petitioners that there are allegations of rioting, house trespass and theft of votes. The incident is alleged to have taken place in the year 2023. The FIR was lodged in 2026. The principal accused has been granted anticipatory bail by the learned jurisdictional Court. He prays for anticipatory bail. 2. Learned advocate appearing for the State submits that on perusal of the materials in the case diary, there is no allegation as such against the petitioner no. 1 whereas there are general and omnibus allegations against the petitioner no. 2. Charge sheet is yet to be submitted. 2
3. Considering the rival contentions and the materials in the case diary, the prayer for anticipatory bail of the petitioners is allowed. 4. Accordingly, I direct that in the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973, corresponding to Section 482(2) of the BNSS and on further condition that the petitioners shall meet the Investigating Officer once in a fortnight till the conclusion of investigation and on condition that the petitioners shall appear on every date before the jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioners in Court including cancelling the anticipatory bail granted without further reference to this Court. 5. Accordingly, CRM (A) 2549 of 2026 is allowed. 6.
