JUSTICE M.NAGAPRASANNA ORAL ORDER Heard Sri. K.V. Vinoda Kumar Naidu, learned counsel appearing for the petitioner, Smt. Waheeda M.M., learned High Court Government Pleader appearing for respondent No.1, Sri. Vasantha Kumar H.N., learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and have placed on record such settlement along with the joint memo. Terms of settlement reads as follows: "JOINT MEMO - 3 - HC-KAR CNR: KAHC010302172025 NC: 2026:KHC:44188 CRL.P No. 6606 of 2025 ." That the Petitioners and the 2nd Respondent in the above mentioned petition most respectfully submit as mention below: 1. It is humbly submitted that a Private Complaint(PCR No. 18/2023) filed by the Respondent No. 2 Smt. Vani W/o Late Venkatesappa before the Hon'ble PRL. Civil Judge and JMFC K.G.F and subsequently stating that allegation of impersonation and forgery concerning the surety affidavit submitted for the Petitioner's bail. In CC 2045/2021 which Entire Proceeding is stayed by this Hon'ble Court. 2. It is humbly submitted that the Complainant Police on basis of the Private complaint filed by Respondent No.2 Smt. Vani W/o Late Venkatesappa before the Hon'ble Prl. Civil Judge and JMFC K.G.F referred to BEML Police Station for alleged incidents happened on 19.11.2021 and same is registered in Cr. No.38/2023 under Section 419, 420, 463, 465, 471, 473 of IPC. 3. It is humbly submitted that The complainant who has no knowledge of the closer of PCR the Complainant has intended to withdraw the complaint has prepared and sworn an affidavit before the Notary and also served a copy to the Petitioner however on the direction of the Trail Court she has submitted the same to the Respondent No. 1 complainant Police, stating that the matter has been compromised hence she is willing to withdraw the Case registered under CR No. 38/2023, she has file this before - 4 - HC-KAR CNR: KAHC010302172025 NC: 2026:KHC:44188 CRL.P No. 6606 of 2025 BEML Police because the PCR 18/2023 on the bases of the reference made by the Trail Court in PCR 18/2023. 4. It is humbly submitted that Respondent No.1 the complainant police had filed the Charge Sheet on 15.01.2025 for offence of under section 419, 420, 463, 465, 471, 473 of IPC. 5. It is humbly submitted that Subsequently Petitioners filed a criminal petition u/s. 482 Cr.PC before this Hon'ble Court challenging the charge sheet and entire proceedings and this Hon'ble Court granted interim order of stay of proceeding in CC 792/2025. 6. It is humbly submitted that the Petitioner and the Respondent No.2 at the advice of the elders and well- wishers of the locality The Petitioner and the 2nd Respondent, Hence have compromised the matter and decided to withdraw the case filed against each other and settle the matter amicably. 7. It is humbly submitted that the Petitioners and the 2nd Respondent submit that there is no coercion, fraud or undue influence in filing the Compromise Joint Memo, The Petitioners and 2nd Respondent has no objection in allowing this Petition Under these Circumstances, the Petitioner and 2nd respondent humbly pray that this Hon'ble Court may be pleased to record the Joint Memo and allow this Petition - 5 - HC-KAR CNR: KAHC010302172025 NC: 2026:KHC:44188 CRL.P No. 6606 of 2025 for compromising the Matter and pass necessary orders to meet the ends of justice, equity and law." 4. In the light of application for compounding being filed along with the joint memo and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioner in the subject petition. 5. For the aforesaid reasons, the following: ORDER (i) Criminal Petition stands disposed. (ii) Proceedings pending in C.C.No.792/2025 in Crime No.38/2023 of BEML Police Station, Kolar Gold Fields,pending on the file of Prl.Civil Judge & Addl JMFC Court, KGF, qua the petitioner, stands quashed.
