C.R.M. (M) 1454 of 2026
In Re: An application for bail under Section 439 of the Code of Criminal Procedure, 1973 read with Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Baghmundi Police Station Case No.135 of 2023 dated 17.10.2023 under Sections 363/364/302/201/120B of the Indian Penal Code and under Sections 25/27/35 Arms Act, 1959;
Sanjay Sarkar @ Sanjoy Sarkar Versus The State of West Bengal
Mr. Pawan Kumar Gupta Mr. Piyush Choudhury Ms. Laboni Ghosh Ms. Sofia Nesar Ms. Papiya Patra. ...for the petitioner.
Mr. Pradip Banerjee Mr. BankimPal. …for the State.
Learned advocate appearing for the petitioner submits that the petitioner is innocent and has been falsely implicated in connection with the instant case on a fake recovery being shown. Petitioner is in custody for 2 years 5 months and he may be released on bail as there is no possibility of the trial being taken to its logical conclusion. Additionally, it has been submitted that 8 persons have been granted bail.
Learned advocate for the State opposes the prayer for bail.
I have taken into account the overall materials appearing
2 in the case diary and the summary of the events are that two witnesses were abducted from a court of Jharkhand brought within the district of Purulia fired at and the case has been registered in respect of double murder case.
Having considered the heinousness of the offence and the materials appearing against the petitioner, I am of the opinion that this is not a fit case for releasing the petitioner on bail.
Accordingly, CRM(M)1454 of 2026 is dismissed.
Memo of Evidence submitted by the State be kept with the record.
