CRM (A) 2640 of 2026
In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Haringhata Police Station case no. 92 of 2026 dated 12.02.2026 under Sections 318(4)/338/351(2) of the Bharatiya Nyaya Sanhita,
2023. And In the matter of : Saradindu Ray @ Roy. ……Petitioner. Mr. Shibaji Kr. Das Mr. Dipendu Sarkar Ms. Deblina De Ms. Moitriyee Das
.....for the Petitioner. Mr. Krishnendu Bhattacharya Ms. Priti Kar Bagchi
……for the State. Supplementary affidavit filed by the petitioner be kept with the record. Learned advocate appearing for the petitioner submits that petitioner is an Assistant Teacher of Narayanpur GSF Primary School. Petitioner denies the allegations which have been made in the letter of complaint treated to be the First Information Report of the present case and submits that with change of administration number of cases have been instituted against the present petitioner. According to the petitioner, the facts which have been averred in the letter of complaint are afterthought and the same are delayed. Learned advocate appearing for the State opposes the prayer for anticipatory bail and submits that there are number of criminal cases pending against the present petitioner. 2 I have taken into account the other cases which are against the petitioner. It has been pointed out by the petitioner also that one of the accused has been granted anticipatory bail. Be that as it may, there are two folds allegations, one relating to the allurement for providing job and the second relating to the non-payment of part of the money relating to the property which the petitioner purchased from the informant. Having considered that the petitioner involved in number of offences, I am not inclined to grant the relief as prayed for. However, if the petitioner appears before the jurisdictional Court and prays for regular bail, the jurisdictional Court would take into account the factum of petitioner being in school service and independently consider the application for bail without being influenced by any observations made by this Court. With the aforesaid observations CRM (A) 2640 of 2026 is disposed of. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
