Learned advocate appearing for the petitioner submits that the petitioner was arrested on 03.03.2025 and since then he is in custody. There has been no progress in the trial of the case and the recovery in the present case is questionable.
Learned advocate for the State submits that evidence of the 3rd prosecution witness is in progress. There has been alleged recovery of 4.757 kgs. of heroin.
Having considered the quantity of contraband seized, I am of the opinion that the rigors of Section 37 of the NDPS has
2 been attracted.
Petitioner approached the Hon’ble Supreme Court in Special Leave to Appeal (Crl.) 2127 of 2026 and the Hon’ble Supreme Court by an order dated 09.02.2026 was pleased to refuse the prayer for bail of the petitioner.
Be that as it may, petitioner is in custody for 1 year 5 months. Consequently, the trial court would ensure that at least one witness is completed in a month so that the trial is completed within a reasonable period of time.
With the aforesaid observations, CRM(NDPS)1772 of 2026 is dismissed. Memo of Evidence submitted by the State be kept with the record.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
