Accused Nos.2 and 3 in Crime No.209/2026 was registered by Chintamani Rural Police Station, Chikkaballapura, for the offences punishable under Sections 115(2), 118(1), 109(1), 329(4), 352, 351(2) and 3(5) of BNS, 2023, are before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.209/2026 was registered by Chintamani Rural Police Station, Chikkaballapura, against Naveen and two others based on the first information dated 16.06.2026 received from Sudhakar S/o Shivanna. Apprehending arrest in the case, petitioners had filed Crl.Misc.No.177/2026 before the jurisdictional Sessions Court which was rejected on 03.07.2026. Perusal of the first information would go to show that victim Sudhakar and accused No.1 - Naveen had earlier fought against each other and a case was registered against Sudhakar. Therefore, they had ill-will against each other. On 16.06.2026, when the first informant was in his house with his parents, accused persons who came there, after abusing him, allegedly had assaulted him with machets and caused injuries. In the FIR, offences punishable under Sections 115(2) and 118(1) of BNS, 2023, are invoked along with other offences and it is also mentioned that victim has suffered minor injuries. Though learned HCGP has been granted sufficient time to produce the wound certificate, he has failed to produce the same as on this date. It is not in dispute that petitioners do not have criminal antecedents. A reading of the spot panchanama would go to show that weapons used to commit the offences has been already recovered and seized in the present case. Petitioners have undertaken to cooperate with the police for the purpose of investigation. Under the circumstances, the following order:- 5. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release - 4 - HC-KAR CNR: KAHC010498392026 NC: 2026:KHC:45284 CRL.P No. 10825 of 2026 the petitioners in the event of their arrest in Crime No.209/2026 was registered by Chintamani Rural Police Station, Chikkaballapura, for the offences punishable under Sections 115(2), 118(1), 109(1), 329(4), 352, 351(2) and 3(5) of BNS, 2023, subject to the following conditions: 1. The Petitioners shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3.
