Non-applicant For Applicant : Ms. Lata Nayak, Advocate For Non-applicant : Mr. Jitendra Shrivatava, GA Hon’ble Shri Justice Rakesh Mohan Pandey Order On Board 18.09.2026 1) This is the fourth bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 360/2024 registered at Police Station Torwa, District Bilaspur (C.G.), for the offence punishable under Section 318(4) of the Bharatiya Nyaya Sanhita, 2023 and Section 66(3) of the Information Technology Act. Earlier, three bail applications were rejected by the Coordinate Bench in MCRC No. 6296 of 2025 vide order dated 30.10.2025, MCRC No. 5214 of 2026 vide order dated 17.06.2026, and MCRC No. 7740 of 2026 vide order dated 20.08.2026. 2 2) According to the prosecution story, the complainant, Neeraj Kumar Singh, received a call in the name of the Customs Office, Delhi, informing him that several cases had been registered against him and that he would be investigated by the CBI, pursuant to which he was subjected to digital arrest. Thereafter, on 13.09.2024, an amount of Rs. 16,50,047/- was transferred through RTGS from his SBI account at Titli Chowk Branch, Bilaspur, to ICICI Bank account No. 110405003002 belonging to co-accused Asad Ahmed. On the basis of the aforesaid allegations, the alleged offence was registered against the applicant, and subsequently, the applicant was arrested. Hence, the bail application. 3) Learned counsel for the applicant would submit that the applicant has been falsely implicated and did not receive any amount from the complainant, as the amount was transferred to the bank account of co- accused Asad Ahmed. She further submits that the applicant has no connection with the mobile number or bank account mentioned in the FIR, no recovery has been made from him, and he is in jail since
05.05.2025. The trial is likely to take some time for its conclusion. Therefore, he prays for grant of regular bail to the applicant.
4) Learned State counsel submits that the present is the fourth bail application, as the earlier three bail applications were rejected by the Coordinate Bench in MCRC No. 6296 of 2025 vide order dated 30.10.2025, MCRC No. 5214 of 2026 vide order dated 17.06.2026, and MCRC No. 7740 of 2026 vide order dated 20.08.2026, and there is no substantial change in circumstances. He further submits that the applicant is involved in a cyber fraud case involving digital arrest and cheating, wherein an amount of Rs. 16,50,047/- was transferred to an
3 account connected with the accused persons. Sufficient material is available against the applicant, and two other criminal cases are also pending against him. Therefore, he prays for rejection of the bail application. 5) I have heard learned counsel for the parties and perused the case diary. 6) Having considered the submissions made by learned counsel for the parties and having gone through the material available on record, it is not in dispute that the earlier three bail applications filed by the applicant were rejected by the Coordinate Bench vide orders dated 30.10.2025, 17.06.2026 and 20.08.2026 passed in MCRC Nos. 6296 of 2025, 5214 of 2026 and 7740 of 2026, respectively. There is no substantial change in circumstances thereafter. The allegations against the applicant are serious in nature and relate to cyber fraud involving digital arrest and cheating, wherein an amount of Rs. 16,50,047/- was transferred to an account connected with the accused persons. Further, two other criminal cases are pending against the applicant. Considering the overall facts and circumstances of the case, I do not find any good ground to entertain this fourth bail application. Accordingly, the bail application is rejected.
