Learned advocate appearing on behalf of the petitioners submits that the petitioner no. 1 has already been arrested. 2. Accordingly, the application for anticipatory bail is dismissed as infructuous so far as the petitioner no. 1 is concerned. 3. Learned advocate appearing on behalf of the petitioner submits that the petitioner no. 2 happens to be the nephew of the de facto complainant. He also submits that the petitioner no. 2 has been falsely implicated in this case due to property disputes among the family members. 4. At the time of hearing, learned advocate for the State refers to the materials in the case diary. He also relies upon seizure list by which the receipts of the alleged stolen properties were seized, as produced by the de facto complainant. However, no stolen articles appear to have been recovered in course of investigation. 2 5. Considering the aforesaid facts and circumstances of the case, the nature of the allegations as well as the materials in the case diary, the prayer for anticipatory bail of the petitioner no. 2 is allowed. 6. Accordingly, I direct that in the event of arrest, the petitioner no. 2 (Baitul Mukaddesh) shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973, corresponding to Section 482(2) of the BNSS and on further condition that the petitioner no. 2 shall meet the Investigating Officer once in a fortnight till the conclusion of investigation and on condition that the petitioner no. 2 shall appear on every date before the jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioner no. 2 in Court including cancelling the anticipatory bail granted without further reference to this Court. 7. Accordingly, CRM (A) 2536 of 2026 is disposed of. 8. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities. (Md.
