JUSTICE S VISHWAJITH SHETTY ORAL ORDER 1. Accused Nos.2 and 3 in Crime No.184/2026 registered by Suryanagar Police Station, Bengaluru, for the offences punishable under Sections 140(2) and 351(2) of BNS, 2023 and Section 25 of Indian Arms Act, 1959, are before this Court in these two petitions filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.184/2026 was registered by Suryanagar Police Station, Bengaluru, for the aforesaid offences against one Praveen and unknown three others, based on the first information dated 02.06.2026, received from Dayanand Reddy, S/o late B. N. Thimma Reddy, who is the alleged victim in the present case. During the course of investigation, accused No.2 was arrested on 03.06.2026 and accused No.3 was arrested on 04.06.2026. Their bail application filed before the jurisdictional - 4 - HC-KAR CNR: KAHC010484102026 NC: 2026:KHC:44931 CRL.P No. 10474 of 2026 C/W CRL.P No. 10475 of 2026 Sessions Court was rejected. Therefore, they are before this Court in these petitions. 4. Learned counsel for the petitioners submits that, accused Nos.1 and 4 have been already granted regular bail by this Court in Crl.P.No.10059/2026 and in Crl.P.No.9494/2026. Petitioners have no other criminal antecedents. Accordingly, he prays to allow the petitions. 5. Per contra, learned Addl. SPP, who has opposed the petitions however, does not dispute the submission made by learned counsel for the petitioners. She submits that Test Identification Parade is yet to be conducted and accordingly, prays to dismiss the petitions. 6. Accused No.4 had approached this Court in Crl.P.No.9494/2026, which was allowed on 05.08.2026. In paragraph Nos.4 and 5 of the said order, it is observed as follows:- "4. In the first information dated 02.06.2026, the alleged victim has averred that, on 01.06.2026 at about 04.30 p.m., he had gone in his car bearing - 5 - HC-KAR CNR: KAHC010484102026 NC: 2026:KHC:44931 CRL.P No. 10474 of 2026 C/W CRL.P No. 10475 of 2026 Reg.No.KA21/MC0006 along with his driver to Gold Coin Club and while he was returning from the club at about 12.15 hours on 02.06.2026, some persons who came in a motorbike, intercepted his car and asked his driver to get down from the car. Thereafter, one amongst them sat in the driver's seat and after threatening him with a gun, drove the car. Subsequently, a red-coloured car approached, in which the victim was kidnapped. The persons who came in the said car allegedly threatened him and informed him that they had supari for a sum of Rs.10 crores to commit his murder and they were all speaking in Malayalam language. He submits that one amongst the said persons was by name Praveen and it is under these circumstances, FIR was registered against Praveen and others for the aforesaid offences. 5. Remand application of the arrested accused would go to show that Praveen was known to the first informant even prior to the alleged date of incident. It appears that there was a road traffic accident on 08.11.2025 and for the purpose of repairing the car of the alleged victim in the present case, Praveen had issued a cheque to him which was dishonored. First informant has suppressed the said aspect in the complaint lodged by him before the police. " 7. Subsequently, accused No.1 has been granted regular bail by this Court in Crl.P.No.10059/2026. Considering the aforesaid aspects of the matter, I am of the opinion that the - 6 - HC-KAR CNR: KAHC010484102026 NC: 2026:KHC:44931 CRL.P No. 10474 of 2026 C/W CRL.P No. 10475 of 2026 prayer made by the petitioners, who have no criminal antecedents, is required to be answered affirmatively. Accordingly, the following order:- 8. The petitions are allowed. The petitioners are directed to be enlarged on bail in Crime No.184/2026 registered by Suryanagar Police Station, Bengaluru, for the offences punishable under Sections 140(2) and 351(2) of BNS, 2023 and Section 25 of Indian Arms Act, 1959, subject to the following conditions: a) Petitioners shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not involve in similar offences in future; - 7 - HC-KAR CNR: KAHC010484102026 NC: 2026:KHC:44931 CRL.P No. 10474 of 2026 C/W CRL.P No. 10475 of 2026 e) The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
