1) Pursuant to order dated 6th August, 2026 matter is taken up for consideration when Mr. Das, learned Additional Government Pleader representing the State respondents has filed a report dated 19th August, 2026 of Officer-in-Charge, Noapara Police Station, Barrackpore Police Commissionerate and same is taken on record. Copies of said report are made over to learned advocates representing the petitioner and respondent nos. 6 and 7. 2) It is submitted on behalf of the State respondents that the concerned police authorities have taken steps in terms of order dated 23rd February, 2026 of the learned Executive Magistrate, Barrackpore thereby at
2 present vehicles are not being parked impacting ingress and egress of the petitioner. 3) Respondent nos. 6 and 7 are represented by learned advocate who has submitted that order passed by the learned Executive Magistrate is complied with and vehicles are not parked on the pathway. 4) However, submissions made on behalf of the State respondents and respondent nos. 6 and 7 are disputed by learned advocate representing the petitioner. It is submitted that still vehicles are parked. 5) Considering submissions made on behalf of the respective parties and taking note of report dated 19th August, 2026 of Officer-in-Charge, Noapara Police Station being respondent no. 5, concerned police authorities are directed to keep strict vigil so that no vehicles will be allowed to park on the pathway impacting ingress and egress of the petitioner till the order passed by the learned Executive Magistrate dated 23rd February, 2026 subsists. 6) Writ petition stands disposed of. 7) However, this order shall not preclude respondent nos. 6 and 7 to take steps in accordance with law, if occasion so arises. 8) All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
