1. Prayer made by the petitioner for releasing payment in respect of surgical disposal items supplied by the petitioner is alleged to be kept pending before the Director, Directorate of Health Services for a considerable period of time.
2. The petitioner claims to have supplied the goods nearly ten years back. No payment for the goods has been released.
3. Learned advocate for the petitioner prays for similar relief as granted by the Court on 20.09.2021 in WPA/161/2021 in the matter of M/s Thangavelu Traders and another vs. The Andaman and Nicobar Administration and others.
4. Prayer has also been made for grant of interest for the delayed payment that will be made by the authority.
5. Upon hearing the submissions made on behalf of both the parties and on perusal of the documents annexed to the writ petition, it appears that the petitioner’s representation seeking release of payment is pending consideration at the end of the respondent authority. No useful purpose will be served by keeping the writ petition pending.
6. The writ petition is disposed of by directing the respondent no.2, the Director, Directorate of Health Services to consider and dispose of the petitioner’s prayer for releasing the payment strictly in accordance with law and in line with the
order passed in the matter of M/s Thangavelu Traders(supra), at the earliest, but positively within a period of six weeks from the date of communication of this order.
7. If any amount is found to be due and payable, then, steps shall be taken to release the same without any further delay.
8. If the prayer of the petitioner is disallowed, then, a reasoned therefore shall immediately be communicated to the petitioner.
9. The writ petition stands disposed of. There shall be no
order as to costs.
10. All parties are directed to act on a server copy of this
order duly downloaded from the official website of this Court.
