The applicant has preferred this First Bail Application under Section 483 the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail as he has been arrested in connection with Crime No. 358/2025 registered at Police Station Sirgitti, District Bilaspur (C.G.) for the offence under Sections 126, 191(3), 190, 103(1) of BNS, 2023 & Sections 25 & 27 of the Arms Act. As per the prosecution story, at the instance of Rupesh Dhruv, a dihati nalishi was registered on 11.7.2025 to the effect that at around 9:30 PM, he was informed by Sanju Yadav and Sonu Yadav that near the Government Fair Price Shop, Ganesh Nagar, Nayapara, Ritu Patre, Jayant @ Konda, Dharmendra Patre @ Puklu, Manisha Keshkar, Naman Keshkar and others, armed with wooden clubs and an iron rod, stopped his brother, Kailash Dhruv, and brutally assaulted him. When the informant intervened, he was also assaulted. The dead body of the deceased, Kailash Dhruv, was recovered on 12.7.2025 at about 5:45 PM from a ditch. On the basis of the said complaint, the police registered an FIR against Jayant Patre, Dharmendra Patre and Manisha Keshkar on 13.7.2025. After completion of the investigation, the charge-sheet has been filed.
3. Learned counsel for the applicant would argue that the applicant is innocent and has been falsely implicated in this case. He would contend that initially, the name of the applicant was not mentioned in the FIR and that subsequently, he was made an accused on the basis of the memorandum statements of the co-accused persons. It is also argued that the police have not seized any article at the instance of the present applicant. He would submit that there are a total of 19 witnesses and that, till now, only one witness has been examined, whereas the applicant is in jail since 13.7.2025. Thus, he would pray for grant of bail.
4. On the other hand, learned State counsel would oppose the
submissions made by learned counsel for the applicant. He would argue that the incident was witnessed by Sanju Yadav and that the said witness, in his statement recorded under Section 180 of the BNSS, has
3 named the present applicant. He would submit that the said witness narrated the entire incident in his statement. It is also argued that the co-accused persons, in their memorandum statements, disclosed the involvement of the present applicant. He would submit that this bail application deserves to be rejected.
5. I have heard learned counsel for the parties and perused the case diary.

Having considered the fact that there is an eyewitness account against the present applicant, it appears that Sanju Yadav, who is an eyewitness, has categorically stated that the deceased was assaulted by the applicant and his associates by means of wooden clubs, an iron rod, hands and fists, as a result of which he sustained serious injuries. It is also stated that Sanju Yadav and Rupesh Dhruv were threatened and, therefore, they fled from the spot. On the next date, the dead body of the deceased, Kailash Dhruv, was recovered from a ditch. The accused persons, namely, Jayant Patre, Dharmendra Patre and Manisha Keshkar, in their memorandum statements, have named the present applicant.
7. Having considered the above-discussed facts and the evidence available against the present applicant in the case diary, I am not inclined to allow this bail application.
8. Accordingly, the bail application of the applicant filed under Section 483 of BNSS, 2023 is rejected. Sd/-
