Accused in S.C.No.62/2026 pending before the Court of XXVI Additional City Civil and Sessions Judge, Bengaluru, arising out of Crime No.105/2025 for the offences punishable under Sections 109 and 352 of BNS, 2023 is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the petitioner and the learned HCGP for the respondent - State. 3. The FIR in Crime No.105/2025 is registered by the Halasur Police Station, Bengaluru against the petitioner herein based on the first information dated 12.05.2025 received from Shivakumar, who is the injured victim in the present case. During the course of investigation, petitioner was arrested on 13.05.2025 and remanded to judicial custody. After completing investigation, the charge sheet is filed against him for the aforesaid offences. His bail application filed before the Sessions - 3 - HC-KAR CNR: KAHC010453872026 NC: 2026:KHC:45764 CRL.P No. 9698 of 2026 Court in Crl.Misc.No.25536/2026 was rejected on 20.06.2026. Therefore, he is before this Court. 4. Learned counsel for the petitioner submits that the injured victim was a stranger to the petitioner and the incident in question had taken place after there was a quarrel between the parties regarding parking of the vehicle. He submits that in all the other criminal cases registered against the petitioner, he has been enlarged on bail. The marriage of the petitioner's sister is scheduled to be held on 07.09.2026. He accordingly prays to allow the petition. 5. Per contra, learned HCGP submits that petitioner is a person with criminal antecedents and injured victim had suffered grievous injuries as a result of the assault made by this petitioner and accordingly prays for dismissal of the petition. 6. In the first information submitted by alleged victim on 12.05.2025, it is stated that on the said date, at about 8.00 p.m., the first informant arrived near his house from his Office in his car and parked the same on the road outside his house. - 4 - HC-KAR CNR: KAHC010453872026 NC: 2026:KHC:45764 CRL.P No. 9698 of 2026 When he was about to get down from the car, petitioner who came in a motorbike riding pillion, allegedly abused him and assaulted him with a knife on his stomach. As a result, he sustained grievous injuries and was immediately shifted to the Hospital. On enquiry, he learnt that name of the assailant was Ramu. Therefore, FIR was registered against the petitioner. 7. From the aforesaid, it is apparent that petitioner and the victim were total strangers and petitioner had no motive against the petitioner. In all the other criminal cases registered against the petitioner, he has been enlarged on bail. So far as the present case is concerned, he is in custody for more than 15 months. Learned counsel for the petitioner has produced the marriage invitation card of the petitioner's sister and perusal of the same would go to show that marriage is scheduled to be held on 07.09.2026. Considering the aforesaid aspects of the matter, I am of the opinion that the petitioner’s prayer for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following:- 8. The petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.62/2026 pending before the Court of - 5 - HC-KAR CNR: KAHC010453872026 NC: 2026:KHC:45764 CRL.P No. 9698 of 2026 XXVI Additional City Civil and Sessions Judge, Bengaluru, arising out of Crime No.105/2025 for the offences punishable under Sections 109 and 352 of BNS, 2023, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off. f) The petitioner shall appear before the Station House Officer of Halasur Police Station, Bengaluru on every 1st and 3rd Sunday of every month - 6 - HC-KAR CNR: KAHC010453872026 NC: 2026:KHC:45764 CRL.P No. 9698 of 2026 between 10.00 a.m. and 3.00 p.m., and shall mark attendance regularly for a period of one year from the date of his release from custody.
