Out of the three victims, one minor victim is present before this Court today and has raised no objection to the grant of bail to the applicant. 2. The applicant has preferred this 2nd bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita Act 2023 for grant of regular bail as he is arrested in connection with crime No. 33/2026, registered at Police Station – Chakradhar Nagar Raigarh, District- Raigarh (C.G.) for offence punishable under Sections 3, 4, 5, 5(1)(d)(ii) of Immoral Traffic (Prevention) Act Section 4 of the POCSO Act, 2012. 3. First bail of the applicant was rejected vide order of this Court dated 13.04.2026 passed in MCRC No.3137/2026. 4. There are 3 victims and 2 accused in this case. Learned counsel for the applicant submits that out of 3 victims, one is minor girl and the other two 2 are majors ladies. As per the prosecution case, on information SHUBHAM SINGH RAGHUVANSHI Digitally signed by SHUBHAM SINGH RAGHUVANSHI Date: 2026.09.21 14:33:57 +0530 2 being received on 01.02.2026 the Police raided the residence of one Santosh ‘Soni in in Kelo Vihar Colony, P.S. Chakradhar Natgar District Raigarh, During the raid, the applicant Nagendra was found in a room with a woman. The investigation revealed that the co-accused Dimpy Izardar, a tenant of the house of Santosh Soni, allegedly used the premises to run brothel activities, bringing women there for prostitution. Subsequently, FIR was registered for the said offence and the applicant was arrested on 02.02.2026. 5. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the crime in question. The victims have examined before the Trial Court and turned hostile. On the same facts and circumstances, co-accused Dimpi @ Rahul Izardar has already been granted bail by this Court vide order dated 31.08.2026 passed in MCRC No.7786/2026. The applicant is in jail since 2.2.2026, the trial is likely to take time to be finalized, therefore, it is prayed that the applicant may be enlarged on bail. 6. Per contra, learned Counsel appearing on behalf of the State opposes the bail application. 7. I have heard learned Counsel appearing for the parties and perused the material available on record. 8. Considering the facts and circumstances of the case, the evidence collected by the prosecution, the period of detention of the applicant, the fact that the victims have turned hostile, the fact that the co- accused has already been granted bail by this Court and that the trial is likely to take some time for its conclusion, without commenting further on the merits of the case, I am inclined to release the applicant on bail. 9. Accordingly, the bail application is Allowed. 10. It is directed that the applicant shall be released on bail on executing a personal bond for a sum of Rs. 20,000/- with one solvent surety for the like sum to the satisfaction of the Trial Court for his appearance before the said Court as and when directed.
