Accused No.1 in Crime No.64/2026 registered by Chitradurga Women Police Station, Chitradurga, for the offences punishable under Sections 115(2), 351(2), 64(2)(m), 352 and 3(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.64/2026 was registered by Chitradurga Women Police Station, Chitradurga, against the petitioner and two others based on the first information dated 09.06.2026 received from the alleged victim lady aged 35 years. During the course of investigation of the case, petitioner was arrested on 09.06.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.628/2026 was rejected on 13.07.2026. Perusal of the material on record would go to show that victim lady is married to one Puttaraju and from the said wedlock, the couple have two children. It appears that Puttaraju is working at Bengaluru and he used to visit his house at Chitradurga once or twice in month. Victim lady, who was acquainted to accused No.2, who is the wife of the petitioner/accused No.1, subsequently, developed friendship with accused No.1. About three years prior to registration of the FIR, accused No.1, who came to her house allegedly had sexual intercourse with her. Allegation against accused No.1, is that thereafter, he was threatening the victim lady and was having sexual intercourse with her. 5. In the first information, it is also mentioned that when accused No.1 was in the house of first informant, his wife and mother-in-law came to the said house and after abusing the victim lady, they allegedly took the photographs and videos of the victim lady with accused No.1 and had forwarded the same to her husband. It is only thereafter, victim lady had approached the police and based on her first information, FIR has been registered against the petitioner, his wife and mother- - 4 - HC-KAR CNR: KAHC010512322026 NC: 2026:KHC:45520 CRL.P No. 11271 of 2026 in-law. Accused Nos.2 and 3 have been granted regular bail by the jurisdictional Sessions Court. Considering the nature of allegations found in the first information, it is apparent that petitioner and the victim lady, who are married, were in a consensual relationship and only when the wife and mother-in- law of petitioner came to the house of the alleged victim when she was with the petitioner and had forwarded their photographs and videos to the husband of the victim lady, she had approached the police. Under the circumstances, the following order:- 6. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.64/2026 registered by Chitradurga Women Police Station, Chitradurga, for the offences punishable under Sections 115(2), 351(2), 64(2)(m), 352 and 3(5) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; - 5 - HC-KAR CNR: KAHC010512322026 NC: 2026:KHC:45520 CRL.P No. 11271 of 2026 b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; Sd/- (S VISHWAJITH SHETTY) JUDGE DN List No.: 1 Sl No.: 98
