Kausik (Allowed) CRM (M) 716 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Berhampore Police Station Case No. 620 of 2020 dated 29.06.2020 under sections 376/370/372/373/34 of the Indian Penal Code and Sections 3/4/5/7 of ITPA 1956 and Sections 4/8/12/17 of the POCSO Act and Section 75 of the JJ Act. And In the matter of : Imam Sk ……Petitioner. Mr. Arnab Chatterjee Mr. Anisur Rahaman ……for the Petitioner. Mr. L. Vishal Kumar ….for the State. Learned advocate appearing for the petitioner has referred to the order sheets and pointed out that Ajoy Sarkar has been granted bail in this case. State has produced the certified copy of the witnesses whose depositions have been completed before the learned Trial Court. I have taken into account the deposition of the two victims who have been cited as witness. Primarily, it reflects that Ajoy Sarkar the accused who has been granted bail in CRM (DB) 53 of 2025 is on a similar footing as the present petitioner. 2 Petitioner is in custody for more than 3 years and 6 months. The other accused has been granted bail on 28.03.2025. Having considered the stage of the case and that some time more will be required to take the trial to its logical conclusion. only on the ground of parity, I am inclined to release the petitioner on bail. Accordingly, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Imam Sk shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned CJM, Berhampore. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Murshidabad without the prior permission of the learned Trial Court. With the aforesaid observations CRM (M) 716 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. 3 Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
