3.
Learned counsel for the applicant would submit that there are false allegation against the present applicant; charge-sheet has been filed and applicant is in jail since 06.01.2026. It is contended that he has no criminal antecedents and till now, single witness has not been examined by the prosecution. Thus, he would pray for grant of bail.
4. On the other hand, learned counsel for the State would oppose the bail application. She would submit that the present applicant outraged the modesty of the minor victim while she was going to her school in presence of her friends. She would further submit that looking to the seriousness of the allegations, the present application deserves to be rejected.
5. On 19.08.2026, father of the complainant/victim appeared before this Court through video conferencing and strongly objected to grant of bail to the applicant.
6. I have heard learned counsel appearing for the parties and perused the case diary.
7. In the present case, the investigation is complete and the charge-sheet has been filed. The applicant is in jail since 06.01.2026. Further, not a single witness has been examined by the prosecution. Therefore, without making any observation on the merits of the case, I am inclined to allow this application.
8. Accordingly, the regular bail application is allowed and it is directed that in the event of the applicant executing a personal bond for a sum of Rs.50,000/- each with one surety in the like sum to the satisfaction of the concerned trial Court, he shall be released on bail on the following conditions:- (i) he shall not directly or indirectly make
3 any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court; (ii) he shall not act in any manner which will be prejudicial to fair and expeditious trial, & (iii) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
