And In the matter of: Saidul Islam @ Ripon … petitioner Mr. Gopal Chandra Das Mr. Mahaboob Ahmed Ms. Ananya Das … for the petitioner Mr. Amal Kumar Datta Mr. Pritom Banerjee … for the State Ms. Sima Ghosh … for the de facto complainant Mr. Ghosh, learned Counsel appearing on behalf of the petitioner, submits that the victim and the petitioner have recently resumed their conjugal relationship and are presently residing peacefully together at the petitioner's residence. In such circumstances, learned Counsel submits that, in the interest of justice, the petitioner may be extended the benefit of Section 482 of the BNSS. Ms. Ghosh, learned Counsel appearing on behalf of the State, concurs with the submission made on behalf of the petitioner and submits that the State would have no objection if the petitioner is extended the benefit of Section 482 of the BNSS. Mr. Datta, learned Counsel for the State, produces the Memo. of evidence, case diary and left the matter to the discretion of the 2 Court. The Memo. evidence as placed on behalf of the State is taken on record. Taking note of the subsequent development that the petitioner and the victim have resumed their marital relationship, as well as the stand taken by the de facto complainant, I am of the view that, having regard to the facts and circumstances of the case, the petitioner may be extended the benefit of Section 482 of the BNSS. Accordingly, it is ordered that in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) with two sureties of like amount each, to the satisfaction of the ACJM, Rampurhat and also be subject to the conditions as laid down under Section 482(2) of the BNSS, 2023. The application for anticipatory bail is, thus, allowed. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
