Versus The State of West Bengal Mr. Amanul Islam Mr. Sourav Mukherjee. …for the petitioners. Mr. Aniruddha Bhattacharya Ms. Priti Kar Bagchi. …for the State. Learned advocate appearing for the petitioners submits that the petitioners are in custody since 24.02.2025. The subject matter of recovery in the present case is 25 bottles of Fairdyl Cough Syrup. Report of the State reflects that charge-sheet has already been submitted. The report of the State do not reflect that there are any previous antecedents of the present petitioners and some time will be required by the prosecution as the charge-sheet reflects 9 witnesses. Considering the same, I am inclined to release the petitioners on bail. As such, the prayer for bail of the petitioners is 2 allowed. Accordingly, the petitioners, namely, Abdul Sukuruddin @ Abdul Sukuruddi @ Abdul Sukuddi, Jamirul Islam and Abdul Rajjak shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, under NDPS Act, 3rd Court, Malda. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Malda without prior permission of the learned special court. Thus, CRM(NDPS) 1753 of 2026 is allowed. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
