Learned advocate for the petitioner submits that the petitioner is a relation who has been foisted with a criminal case as the accusations in the FIR referred to indecent proposals. Learned advocate for the defacto-complainant opposes the prayer for bail and submits that the accused was involved in certain overt acts. Mr. Mukherjee, learned advocate, appearing for the State opposes the prayer for bail and has drawn the attention of the court to the statement of the victim under section 183 of the BNSS. It has also been submitted that the next date is fixed for consideration of charges.
2 Having considered that the evidence of the victim is yet to be recorded, I am of the opinion that this is not a fit case for granting bail to the petitioner. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (M) 1279 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
