JUSTICE E.S.INDIRESH ORAL ORDER 1. Heard learned counsel appearing for the parties. 2. In this Writ Petition, petitioner is assailing the endorsement bearing No. LND(I)/CR/2026-27 (E-1232139) dated 01.06.2026 (Annexure-D) passed by respondent No.4, inter alia, sought for a direction to respondent No.4 to place the application made by the petitioner in Form-57 (Annexure-A) with report and other documents before respondent No.5 - Committee for regularisation of unauthorised occupants. 3. Sri. P.V. Chandrashekar, learned counsel appearing for the petitioner referred to the application in Form-57 (Annexure-A) and impugned endorsement dated 01.06.2026(Annexure-D) and contended that, respondent No.4 - 4 - HC-KAR CNR: KAHC010500492026 NC: 2026:KHC:43923 WP No. 22465 of 2026 has rejected the application made by the petitioner on the ground that the respondent No.2 under similar circumstances in R.P.Nos.117 and 118 of 2018 has rejected the application in respect of the subject land therein and accordingly, following the same, has rejected the application made by the petitioner, as per the impugned endorsement dated 01.06.2026, which requires to be interfered with in this Writ Petition, on the sole ground that the claim made by the petitioner is land bearing Sy.No.41 measuring 2 acres of Kalluru Nagenahalli Village, Mysuru District. 4. Per contra, Smt. B.P. Radha, learned Additional Government Advocate appearing for the respondent - State sought to justify the impugned endorsement produced at Annexure-D to the Writ Petition. 5. In the light of the submissions made by the learned counsel appearing for the parties and on careful consideration of the application made by the petitioner in Form-57, petitioner has made the application with regard to land bearing Sy.No.41 to an extent of 2 acres of Kalluru Nagenahalli Village, Ilavala Hobli, Mysuru Taluk, as per para 10 of the application in Form- - 5 - HC-KAR CNR: KAHC010500492026 NC: 2026:KHC:43923 WP No. 22465 of 2026 57 (Annexure-A), however, perusal of the order at Annexure-E passed by respondent No.2 in R.P.Nos.117 and 118 of 2018, would indicate that the subject land therein is Sy.Nos.20 and 21 of Kalluru Naganahalli Village, Kasaba Hobli, Mysuru Taluk and therefore, I find force in the submission made by the learned counsel appearing for the petitioner, that the subject land in the proceedings in R.P.Nos.117 and 118 of 2018 produced at Annexure-E is different from the land claimed by the petitioner in Sy.No.41 of Kalluru Nagenahalli Village, Mysuru, as per Annexure-A. 6. Accordingly, I pass the following: ORDER (i) The Writ Petition is allowed. (ii) The endorsement bearing No. LND(I)/CR/2026-27 (E-1232139) dated 01.06.2026 (Annexure-D), passed by respondent No.4, is hereby set aside. (iii) Respondent No.4 is directed to place the application in Form-57 (Annexure-A) filed by the petitioner before - 6 - HC-KAR CNR: KAHC010500492026 NC: 2026:KHC:43923 WP No. 22465 of 2026 respondent No.5 - Committee, with relevant documents to enable respondent No.5 - Committee to take decision under the provisions of the Karnataka Land Revenue Act, 1964 and Rules made thereunder in so far as regularisation of unauthorised occupation is concerned, within a period of three months from the date of receipt of certified copy of this order.
