In this application, petitioners have prayed for a direction upon the Court below for expeditious disposal of CRR 2793 of 2026, presently pending before learned Judicial Magistrate, 1st Court, Islampur. Being aggrieved by the delay in disposal of the proceeding, learned Counsel for the petitioners submits that the petitioner being a destitute lady has prayed for maintenance under Section 144 of BNSS for herself and for her three minor children on 22nd January, 2026. The Court below did not make any attempt to expedite the hearing. Therefore, the petitioners have prayed for a direction upon the Court below for expeditious disposal of the said criminal proceeding. Having heard learned Counsel for the petitioners, it appears that the prayer made by the petitioners is innocuous and if it is allowed in terms of the prayer made in the application, the opposite party will have no cause to prejudice and, as such, service of copy of application upon the opposite party is dispensed with.
2 Having heard learned Counsel for the petitioners, the instant application being CRR 2793 of 2026 is hereby disposed with a direction upon the Court below for expeditious disposal of the maintenance application filed by the petitioners. Liberty is also given to the petitioners to pray for interim maintenance application, if any, before the Court below and in the event of filing of such application by the petitioners, the Court below will dispose of such prayer at the earliest. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
