ORAL ORDER
1. Accused nos.4 & 5 in Crime No.254/2025 registered by Bangarpet Police Station, K.G.F., for the offences punishable under Sections 108, 3(5) of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.254/2025 was registered by Bangarpet Police Station, K.G.F., for the aforesaid offences against Arbaar and others based on the first information dated 30.08.2025 received from Manjula - mother of deceased Ajay. Apprehending arrest in the said case, petitioners had filed criminal miscellaneous petitions before the jurisdictional Sessions Court, which was rejected. Therefore, they are before this Court. - 3 -

4. Perusal of the material on record would go to show that deceased was addicted to alcohol and there was a case registered against him as he had misbehaved with the elder sister of accused nos.1 to 3. Therefore, accused nos.1 to 3 were allegedly ill-treating him.
In the charge sheet, it is also alleged that the uncle of deceased had married the wife of accused no.5, and therefore, accused no.5 and his father - accused no.4 were also ill-treating him. 5. Accused no.3 had approached this Court in Crl.P.no.16621/2025 seeking anticipatory bail and the said petition was allowed on 27.01.2026. In paragraph no.6 of the said order, it is observed as under:
"6. Deceased was addicted to alcohol and there was a case registered against him as he had held the younger sister of the petitioner, kissed her and case was pending in Court. Allegation against petitioner and accused nos.1 & 2 is that they used to abuse the deceased stating that he had spoiled the life of their younger sister and threatened to kill him. There is an allegation that accused nos.4 & 5 also quarrelled with the deceased and abused him. The deceased has committed suicide by pouring petrol on himself and

setting fire. The deceased was admitted in hospital between 28.08.2025 till he died on 30.08.2025. It is admitted that the dying declaration of the deceased has not been recorded. Whether the act of the petitioners abusing the deceased and threatening to kill him amounts to abetment to commit suicide is a matter of investigation and trial. Petitioner has undertaken to cooperate with the Investigating Officer in investigation and abide by any conditions to be imposed by this Court. There are no criminal antecedents of the petitioner. Considering the above aspects, petitioner has made out a case for grant of bail with conditions."
6. Considering the aforesaid aspects of the matter, I am of the opinion that petitioners as against whom the allegations are similar to accused No.3, are entitled for the grant of anticipatory bail. Accordingly, the following order:
7. Petition is allowed.
Petitioner's are ordered to be released on bail in the event of their arrest in Crime No.254/2025 registered by Bangarpet Police Station, K.G.F., for the offences punishable under Sections 108, 3(5) of BNS, 2023, subject to following conditions:

(i) Petitioner's shall voluntarily appear before the Investigating Officer within 15 days from this day
and execute bail bond for a sum of Rs.1,00,000/-
with one surety for the likesum to the satisfaction of
the Investigating Officer. (ii) Petitioner's shall appear before the
Investigating Officer whenever called for and
cooperate for investigation. (iii) Petitioner shall not directly or indirectly
make any inducement, threat or promise to any
person acquainted with the facts of the case, so as to
dissuade him from disclosing such facts to the Court
