And In the matter of : Khokan Das
……Petitioner. Mr. Shibaji Kr. Das Ms. Maitrayee Das
.....for the Petitioner. Mr. Brajesh Jha, Ld. APP Mr. Ramashis Mukherjee
……for the State.
Learned advocate appearing for the petitioner submits that petitioner is similarly placed as other accused persons who have been granted bail and petitioner is presently in custody for a period of two years four months. Learned advocate appearing for the State opposes the prayer for bail on merits but is unable to refute the contention that other accused persons namely, Pritam Debnath and Samir Roy are not similarly placed as present petitioner. Emphasize has been made on previous antecedents. I find that the other accused persons have also previous antecedents. Having regard to the issue relating to parity, I am inclined to extend the benefit to the present petitioner. Accordingly, prayer for bail of the petitioner is allowed.
2 As such, the petitioner, namely, Khokan Das shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Additional Chief Judicial Magistrate, Ranaghat, Nadia. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of district of Nadia without prior permission of the learned Trial Court. With the aforesaid observations, CRM (M) 1283 of 2026 is allowed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
