1. The petitioner, in this Writ Petition, has prayed for the following reliefs:-
“10.1 Direct the respondent authorities, particularly respondent No.6/Tahsildar, Saraipali, not to give effect to or execute the order dated 11.09.2026 (Annexure P/1) passed under Section 248 of the Chhattisgarh Land Revenue Code, till the statutory appeal preferred by the petitioner before the learned SDO (Revenue), Saraipali, is considered and decided on merits. 10.2 Direct the respondent authorities not to take any coercive action against the petitioner pursuant to the consequential

and communication dated 11.09.2026, during pendency of the statutory appeal and the application for stay filed by the petitioner.
10.3. Direct the learned SDO (Revenue), Saraipali, to consider and decide the statutory appeal preferred by the petitioner under Section 44(1) of the Chhattisgarh Land Revenue Code, along with the application seeking stay, in accordance with law.
10.4. Grant any other relief which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case."

Learned counsel for the petitioner submits that against the order dated 11.09.2026, the petitioner has preferred an Appeal before the concerned SDO (Revenue), Saraipali, District- Mahasamund, which is fixed for hearing on the day after tomorrow, i.e., on 24.09.2026. He further submits that despite the pendency of the appeal, the authorities are
3 proceeding to dispossess the petitioner from the subject property, whereas, according to the petitioner, he is in lawful possession thereof.
3. Learned State counsel submits that since the Appeal is already pending, the present Petition is not maintainable.
4. At this stage, learned counsel for the petitioner submits that he has also filed an application for stay under Section 52 of the Chhattisgarh Land Revenue Code. However, since there is a threat of dispossession, he has approached this Court.
5. Considering the aforesaid aspects of the matter, the concerned Revenue authorities are directed not to take any coercive steps against the petitioner for a period of one week and the concerned SDO (Revenue) is
directed to consider the application filed by the petitioner and decide the same in accordance with law. Since this Court has not made any observation on the merits of the case, the concerned authority is directed to consider and decide the application for stay filed by the petitioner, in accordance with law, within a period of one week.
6. With the aforesaid observations and directions, the present petition stands disposed of.
