1. Mr. Chandra Shekhar Nainwal, earned counsel for the petitioner.
2. Mr. Himanshu Sain, learned A.G.A. for the State.
3. By the instant petition, the petitioner is praying for the following relief:- (i) A writ order or direction in the nature of certiorari quashing the impugned orders dated 12.03.2026 and direct the respondents to release the vehicle no. UK 04-AS-1675 of the petitioner.
4. On the previous date the State Counsel was directed to get instructions whether the proceeding under Section 133 of the Motor Vehicles Act have been completed.
5. Today, Mr. Sain, learned A.G.A. on instructions apprise to this Court that in terms of Section 133 of M.V. Act the verification is done and the actual owner of the vehicle, which was seized for the offence punishable under NDPS Act, is the petitioner.
6. Since, now the proceeding under Section 133 of M.V. Act has already been concluded and on verification the petitioner is found to be the actual owner of the vehicle, in such view of the matter, the writ petition is allowed and the order dated 12.03.2026 is quashed and the respondents are directed to release the vehicle forthwith in favour of the registered owner of the vehicle.
