The learned counsel for the petitioner submits that the petitioner seeks permission of this Court to withdraw this criminal miscellaneous petition with liberty to move the trial court under Section 210 of Cr.P.C. Learned counsel for the opposite party no.2 submits that since trial is at an advance stage hence, no liberty should be given to the petitioner to file an application under Section 210 of Cr.P.C. which corresponds to Section 233 of B.N.S.S. Since, it is a settled principle of law that a person is at liberty to file an application which he is in law permitted to file and Section 210 of Cr.P.C. do not prescribe any stage at which only, the application under that section can be filed hence, this criminal miscellaneous petition is dismissed as withdrawn with liberty to the petitioner to file application under Section 210 of Cr.P.C.
