Affidavit of service filed by the petitioner is taken on record. Opposite party is not represented. In this application, the petitioner has prayed for a direction upon the Court below for expeditious disposal of Complaint Case No.2844 of 2016 filed under Section 12 of the Protection of Women from Domestic Violence Act, 2005 pending before learned 8th Judicial Magistrate, Alipore. Being aggrieved by the aforesaid proceeding, learned Counsel for the petitioner submits that on 30th June, 2016 the petitioner filed aforesaid application along with a prayer for interim protection. By an order dated 20th April, 2017, learned Court below directed to pay interim monetary relief of Rs.8,000/- per month, against which Criminal Appeal No.248 of 2017 was preferred. The Appellate Court by an order dated 25.03.2022 dismissed the appeal. Thereafter, the matter is kept pending for recording evidence. Since ten years have already passed, the petitioner, therefore, prays for appropriate direction upon the Court below.
2 Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application, the opposite party will have no cause to prejudice and since the matter is pending for last 10 years, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice. In view of above, the instant application being CRR 402 of 2026 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the proceeding being Complaint Case No.2844 of 2016 and to make his best effort to conclude the entire proceeding preferably within a period of 3 (three) months from the next date of hearing. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
