Learned Advocate Mr. Dhruv Thakkar seeks permission to amend the cause title, more particularly, to join the learned Principal District Judge, Dahod as respondent No.5 herein. The permission, as sought for, is granted. The appropriate amendment will be carried out right away. 2. Heard learned counsel Mr.Dhruv Thakkar for the petitioner and learned AGP Ms. Nidhi Vyas for the respondent-State. 3. At this stage, learned advocate Mr. Thakkar seeks permission to withdraw this petition with liberty to file a detailed representation before the learned Principal District Judge, District Court, Dahod, with an appropriate representation seeking for benefit of pension. Learned advocate Mr. Thakkar would submit that in case, such representation is preferred, learned Principal District Judge, Dahod, may be directed to decide the same as expeditiously as possible. In view of the above request, the following directions are issued: (1) The petitioner is at liberty to file a representation to the Principal District Judge, Dahod, by 30/09/2026. (2) In case such representation is preferred within the stipulated time, the learned Principal District Judge, Dahod, shall consider and decide the same strictly in accordance with law as expeditiously as possible, and latest by 30/10/2026. (3) An appropriate reasoned communication/reply shall be provided to the petitioner upon such determination. In case, the learned Principal District Judge, Dahod comes to the conclusion that the petitioners are not entitle to the retiral benefits of her late husband – Bhailalbhai Bhagora then the learned Principal District Judge shall provide a reasoned order to the petitioners. 5. With the above directions, the petition stands disposed of as withdrawn with liberty as prayed for. 6. It is clarified that this Court has not gone into the merits of the matter and whereas, in case of an adverse order, it would be open for the petitioners to approach the appropriate authority in accordance with law.
