BEFORE HON’BLE MR. JUSTICE RAJESH MAZUMDAR ORDER 20.01.2026 Heard Mr B Hussain, learned counsel appearing for the petitioner. Also heard Mr D P Goswami, learned Public Prosecutor for the State of Assam, who has produced the Case Diary.
2. This is an application under Section 482 of the BNSS, 2023, praying for granting pre-arrest bail to the petitioner, namely, Salim Ahmed, who is apprehending his arrest in
Page No.# 2/2 connection with Sorbhog PS Case No. 129/2024, corresponding to GR Case No. 1370/2024, under Sections 61(2)/126(2)/109/117(2)/118(2) of the BNS, 2023.
3. The learned counsel for the petitioner has submitted that in a case arising out of the same FIR, at least 6 (six) of the co-accused have been granted the privilege of pre-arrest bail by this Court.
4. On a perusal of the Case Diary and on the statements made, this Court is of the opinion that the petitioner may be granted the privilege of pre-arrest bail.
5. Accordingly, this Court directs that in the event of arrest of the petitioner named above, he shall be released on bail on furnishing of a bail bond of Rs. 20,000/-(Rupees twenty thousand) with one local surety of the like amount to the satisfaction of Arresting Authority under the following conditions:- i) The petitioner shall cooperate with the investigation and shall appear before the Investigating Officer on or before 30.01.2026, and on such date, as may be fixed by the Investigating Officer. 2) The petitioner shall not tamper with the evidence or influence any of the witnesses. 3) The petitioner shall not leave the jurisdiction of the Investigating Authority without prior permission of the said Authority.
6. The Anticipatory Bail Application, accordingly, stands disposed of.
