1 CGHC010351232026 2026:CGHC:40741 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR MCRC No. 8722 of 2026 1 - Narayan Dhruv Urf Naru S/o Mohan Lal Dhruv Aged About 20 Years R/o Bajrang Chowk, Kumhari, Police Station Kumhari, District Durg, (C.G.) ... Applicant versus 1 - State Of Chhattisgarh Through Station House Officer, Thana Kumhari, District Durg, C.G. ... Non-applicant For Applicant : Mr. Chandresh Shrivastava, Advocate For Non-applicant : Mr.Nitansh Jaiswal, Dy. GA Hon’ble Shri Justice Rakesh Mohan Pandey Order On Board 18.09.2026 1) The applicant has preferred this second Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS'), for grant of regular bail, as he has been arrested in connection with Crime No. 153/2025, registered at Police Station Kumhari, District- Durg (CG) for the offence punishable under Sections 296, 351(3), 109, 191(1), 191(2), 191(3) of BNS. Earlier first bail application bearing MCRC No.1129 of 2026 was rejected on merits vide order dated 03.02.2026. 2) The prosecution story, in brief, is that the applicant/accused, Narayan 2 Dhruv @ Naru, abused the injured Gaurav Tiwari with filthy mother- sister-related abuses and threatened to kill him. It is further alleged that the applicant, along with the co-accused, armed with a sharp knife, committed rioting. The applicant is also alleged to have inflicted a knife blow on the abdomen of the injured with the intention to kill, causing grievous injuries. On the basis of the aforesaid allegations, the alleged offence was registered against the applicant, and subsequently, the applicant was arrested. Hence, the bail application. 3) Learned counsel for the applicant submits that the applicant has falsely been implicated on the basis of omnibus and generalized allegations, without attribution of any specific overt act. He further submits that the co-accused, Kaushal Sonkar and Harsh Sonkar, have already been granted bail by this Court in MCRC No. 9635/2025 vide order dated 05.01.2026, and the applicant stands on the same footing. He contends that the applicant is in custody since 10.08.2025 and the trial is likely to take some time for its conclusion, as out of 20 witnesses, only 6 witnesses have been examined so far. Therefore, he prays for grant of bail to the applicant. 4) On the other hand, learned State counsel opposes the bail application and submits that the charge-sheet has already been filed. He further submits that the applicant abused and threatened the injured and, along with the co-accused persons, armed with sharp and deadly weapons, committed rioting. The applicant also inflicted a knife blow on the abdomen of the injured with the intention to commit murder, causing grievous and life-threatening injuries. Therefore, the applicant is not entitled to grant of bail. 3 5) I have heard learned counsel for the parties and perused the case diary. 6) Having considered the submissions made by learned counsel for the parties and having gone through the material available on record, it is evident that the first bail application filed by the applicant was rejected by this Court on 03.02.2026 in MCRC No. 1129 of 2026. The applicant is in jail since 10.08.2025. The allegation against the applicant is that he inflicted a knife blow on the abdomen of the injured, thereby causing grievous and life-threatening injuries. The medical report also indicates the seriousness of the injuries sustained by the injured. Considering the nature and gravity of the allegation against the applicant, particularly the allegation of inflicting a knife blow on the vital part of the body, I am not inclined to grant bail to the applicant. So far as the contention regarding delay in conclusion of the trial is concerned, out of 20 witnesses, six witnesses have already been examined. Therefore, at this stage, the delay in conclusion of the trial cannot be considered to be a sufficient ground for grant of bail. Considering the overall facts and circumstances of the case, I do not find any good ground to allow this second bail application. Accordingly, the bail application is rejected. However, the learned Trial Court is directed to make all endeavour to conclude the trial expeditiously. Sd/- (Rakesh Mohan Pandey) JUDGE Rekha
