The petitioner who is the wife of the detenu Madhu (CTP No.10184) is before this Court seeking for the following reliefs: a. Issue a Writ of Mandamus or other appropriate writ to the respondents to consider the representaitons dated 05.08.2026 i.e., Annexure B, B1, B2 and B3 to release the Detenue i.e., Madhu @ Madhukumar (CTP No.10184) on a general parole of 90 days. b. Pass any such other order/s as this Hon'ble Court deems fit under the facts and circumstances of the case, in the interest of justice and equity. - 3 - HC-KAR CNR: KAHC010568732026 NC: 2026:KHC:44873 WP No. 25881 of 2026 3. The detenu had been convicted in S.C.No.10028/2014 offences under Section 302 amd 506 of IPC by the IV Additional District and Sessions Judge, Doddaballapur and sentenced on 20.02.2018 with the highest of the sentence being imprisonment for life. The detenu has served a period of 07 years 01 months 18 days of imprisonment as on 27.11.2025 and his conduct in jail is said to be satisfactory. The detenu had earlier been granted Court parole for one time and general parole for three occasions for a period of 10 month 17 days. The petitioner having made an application for parole on 05.08.2026 through register post, the said letter application has not been considered by the respondent. 4. Learned AGA submits that since the application was not submitted in the proper format, the same could not be considered. 5. In applications relating to parole, more so when detenu and/or the family members are not literate and belong to the lower state of society. It would but be required for the respondents to be more liberal in considering the applications. In the present matter, learned counsel for the petitioner submits that all the necessary documents have been submitted. In that view of the matter, this Court passes the following; ORDER i. The writ petition is allowed. ii. A mandamus is issued, directing the respondent to consider the representation dated 05.08.2026 as an application for parole and pass necessary orders within ten days from the date of receipt of this order.
