Learned counsel appearing on behalf of the petitioner submits that the victim as well as the present petitioner were involved in an extra marital relationship for a long period as her husband was a migrant labour, who works in the different places. He prays for anticipatory bail on any terms and conditions.

Learned counsel appearing on behalf of the de-facto complainant strongly opposes the prayer for anticipatory bail and further submits that she had been raped upon threatening to murder her husband.

Learned counsel representing the State produces the memo of evidence as well as case diary and relies upon the statement of the victim under Section 183 of the B.N.S.S. and opposes the prayer for anticipatory bail.
4. Having heard the learned counsels for the respective parties and upon perusal of the memo of evidence, case diary including the statement of the victim under Section 183 of the B.N.S.S., this court finds there are sufficient materials against the present petitioner of the alleged offences.
5. Accordingly, this court is of the view that this case is not a fit case for granting anticipatory bail to the present petitioner.
6. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
7. Memo of evidence filed in court today is taken on record.
8. Consequently, CRM (A) No. 2068 of 2026 is, thus, dismissed.
9. All parties shall act on the server copies of this order duly downloaded from the official website of this court.
10. Concerned Department is directed to supply certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities.
