1. Memo of evidence filed on behalf of the State is taken on record.
2. Having heard the submissions made on behalf of the learned advocate for the petitioner as well as the learned advocate for the State, it transpires that the petitioner along with others is alleged to have assaulted the victim with iron rod, spade etc. with a view to kill. As a result of such incident, the victim died.
3. I have gone through the materials in the case diary, the statements of witnesses recorded under Section 183 of BNSS as well as Section 180 of BNSS, placed the petitioner at the scene of occurrence. They have implicated the present petitioner in the incident. The post mortem report goes to show that death of the victim was due to the effect of intracranial hemorrhage due to blunt trauma of head. The petitioner and other accused persons are settled to have inflicted iron rod blow as well as by spade.

4. Considering the aforesaid materials in the case diary, the nature of allegations and other facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner.
5. Accordingly, the application for anticipatory bail is rejected.
6. CRM(A) 2527 of 2026 stands disposed of.
7. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
