JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused in SC No.390 of 2026 pending before the Court of XLV Additional City Civil and Sessions Judge, (CCH-46), Bengaluru, arising out of Crime No.341 of 2025 registered by Thilaknagar Police Station, Bengaluru City for the offences punishable under Section 109, 351(2), 351(3) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in crime No.341 of 2025 was registered by Thilaknagar Police Station, Bengaluru City against the petitioner, based on the first information dated 18.12.2025 - 3 - HC-KAR CNR: KAHC010483042026 NC: 2026:KHC:43800 CRL.P No. 10429 of 2026 received from Smt.Asma Banu, who is the wife of the petitioner. During the course of investigation of the said case, the petitioner was arrested on 20.12.2025 and remanded to judicial custody. After completing investigation, charge sheet has been filed against him for the aforesaid offences. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.4977 of 2026 was rejected on 27.06.2026. Therefore, he is before this Court. 4. Material on record would go to show that the victim lady is the wife of the petitioner, who is a mechanic by profession. His marriage with the victim lady was performed about 19 years prior to the alleged date of incident and from the said wedlock, they have two children. Allegation as against the petitioner is that he is in the habit of consuming alcohol and he was regularly abusing his wife in his house. On 17.12.2025 at about 11.30 p.m., he had demanded money from his wife for the purpose of consuming alcohol and quarreled with her. - 4 - HC-KAR CNR: KAHC010483042026 NC: 2026:KHC:43800 CRL.P No. 10429 of 2026 When the victim had refused to pay the money, the petitioner assaulted her with a knife, which was used in the house for the purpose of cutting vegetables. Wound certificate of the injured victim would go to show that the injuries suffered by her are simple in nature. 5. It is not in dispute that the petitioner has no other criminal antecedents. He is in custody in the present case from 20.12.2025. Considering the aforesaid aspects of the matter, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following: O R D E R The Criminal Petition is allowed. The petitioner is directed to be enlarged on bail in SC No.390 of 2026 pending before the Court of XLV Additional City Civil and Sessions Judge, (CCH-46), Bengaluru, arising out of crime No.341 of 2025 registered by Thilaknagar Police Station, - 5 - HC-KAR CNR: KAHC010483042026 NC: 2026:KHC:43800 CRL.P No. 10429 of 2026 Bengaluru City for the offences punishable under Section 109, 351(2), 351(3) of BNS, 2023, subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future.
