In the matter of : Banera Bibi & Ors. … petitioners
Mr. Jisan Iqubal Hossain. ….for the petitioners
Mr. Debayan Ghosh.
… for the State
1.
Learned counsel appearing on behalf of the petitioners submits that they are in-laws of the victim, who committed suicide in her matrimonial home. Her husband is in custody. The petitioners are not at all connected with the alleged offence as they reside separately.
2. Furthermore, the FIR was lodged after forty-five days of the incident without explaining delay. He prays for anticipatory bail for the petitioners on any terms and conditions.
3.
Learned counsel representing the State produces the memo of evidence, copy of the Post Mortem Report and
2 the case diary. He relies particularly on the Post Mortem Report and opposes the prayer for anticipatory bail.
4. Having heard the learned counsels for the respective parties and upon perusal of the Post Mortem Report as well as Statement recorded under Section 180 of the B.N.S.S., this court finds that there are materials against the petitioners. Accordingly, this court is of the view that this case is not a fit case for granting anticipatory bail to the present petitioners.
5. Accordingly, the prayer for anticipatory bail of the petitioners is rejected.
6. Memo of evidence, filed in court today, is taken on record.
7. Consequently, CRM (A) No. 2036 of 2026 is, thus, dismissed.
8. All parties shall act on the server copies of this order duly downloaded from the official website of this court.
9. Concerned Department is directed to supply certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities.
