Manjunath R.P., learned counsel appearing for the petitioners; Sri. Spoorthy Hegde N., learned High Court Government Pleader appearing for the respondent-State and Sri. V. Lakshminarayana, learned Senior Counsel appearing on behalf of learned counsel, Sri. Chand Pasha, learned counsel for the respondent No.5 2. In the present writ petition, the petitioners are assailing the order dated 17.03.2026 passed by - 6 - HC-KAR CNR: KAHC010363462026 NC: 2026:KHC:44357 WP No. 16654 of 2026 Respondent No. 2 vide Annexure-A in RRT (HOS) CR No. 109/2026. 3. Sri. Manjunath R.P., learned counsel for the petitioners and Sri. V. Lakshminarayana, learned Senior Counsel appearing for Respondent No. 5, submit that this Court, vide order dated 29.01.2026 passed in W.P. No. 37716 of 2025, produced at Annexure-F, at paragraphs 7 and 8 has held as follows: "7. In that view of the matter, the writ petition is allowed. The impugned order dated 25.09.2025 at Annexure 'A' passed by respondent No.2-Assistant Commissioner, Doddaballapura Sub-Division in proceedings bearing number RA/HOS-35/2023 is hereby quashed and set aside. The matter stands remitted back to the Assistant Commissioner with a direction to the appellants therein to implead the petitioner herein and thereafter proceed in accorance with law. - 7 - HC-KAR CNR: KAHC010363462026 NC: 2026:KHC:44357 WP No. 16654 of 2026 8. If the revenue entries have been changed pursuant to the impugned order, the same shall be restored within a period of one week from the date of receipt of a copy of this order." 4. Taking into consideration the directions issued by this Court in the said writ petition, I am of the opinion that the impugned order dated 17.03.2026 at Annexure-A, passed by Respondent No.2-Assistant Commissioner, is liable to be set aside. Accordingly, the impugned order is set aside and the matter is remitted to Respondent No.2 to consider the observations made by this Court at paragraph 7 of the order dated 29.01.2026 (Annexure-F) in W.P. No. 37716 of 2025. 5. However, the entries made in the revenue records pursuant to the order dated 17.03.2026 at Annexure-A shall continue in the name of Respondent No. 4, in terms of the direction issued by this Court at - 8 - HC-KAR CNR: KAHC010363462026 NC: 2026:KHC:44357 WP No. 16654 of 2026 paragraph 8 of the said order, until the conclusion of the proceedings before Respondent No.2. Accordingly, the writ petition is disposed of. 6.
