Monotosh Bhakto @ Bhola Versus The State of West Bengal
Mr. Amanul Islam Mr. Sourav Mukherjee Mr. Gourav Roy. …for the petitioner.
Mr. Priyankar Ganguly Ms. Shalini Bairagi. …for the State.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for 4½ months and the recovery in the present case is 20 bottles of Eskuf Cough Syrup and 2 kgs. of ganja.
Learned advocate for the State opposes the prayer for bail.
Having considered the report submitted by the police authorities and the fact that there no previous antecedents of the present petitioner, I am inclined to release the petitioner on bail as in this case there is no possibility of the trial being taken to its logical conclusion very soon. As such, the prayer for bail of the
2 petitioner is allowed.
Accordingly, the petitioner, namely, Monotosh Bhakto @ Bhola shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, under NDPS Act, Krishnanagar, Nadia. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Nadia without prior permission of the learned special court.
