Choudhury, learned counsel for the applicant. Also heard Mr. M. P. Goswami, learned APP, Assam. By this application filed under Section 5 of the Limitation Act, 1963, the applicant has prayed for condonation of the delay of 94 days in filing the connected criminal appeal. Learned counsel for the applicant has placed the grounds for condoning the delay as mentioned in the application moreso at paragraph 2 of the said Page No.# 2/2 petition. In the said paragraph, the petitioner states that after the judgment was passed, his family member consulted one lawyer to file an appeal for which he collected the relevant documents. Thereafter, the said family member had shown the records to the said counsel and after perusal of the same there was a decision to prefer an appeal before the Guwahati High Court and a counsel was advised thereafter the family members reached the chamber of the said counsel and handed over the documents and the said exercise took some time and resulted in a delay of 94 days in preferring the appeal. This Court is satisfied with the grounds narrated by the learned counsel for the petitioner as well as stated in the said application and deems it fit to condone the delay and hear the appeal on merits. Accordingly, the delay of 94 days in filing the appeal is condoned, for the ends of justice. The Registry is directed to register the appeal and list it for admission.
