JUSTICE E.S.INDIRESH ORAL ORDER Heard Sri. Gopalakrishnamurthy C., learned counsel appearing for the petitioners, learned High Court Government Pleader appearing for respondent Nos.1 to 3 and Sri. Pradeep J.S., learned counsel appearing for respondent No.7. 2. In this writ petition, the petitioners are assailing the order dated 17.07.2019 (Annexure-A) in R.P.No.1/2011-12 and the order dated 17.01.2011 (Annexure-C) in R.A(NE).No.169/2007-08, inter-alia sought for direction to respondent No.3 to consider the application dated 31.07.2019 (Annexure-M) submitted by the petitioners for entering the name of the petitioners in the revenue records. 3. Sri. Gopalakrishnamurthy C., learned counsel appearing for the petitioners contended that, though respondent No.1 dismissed the revision petition, liberty - 5 - HC-KAR CNR: KAHC010099942023 NC: 2026:KHC:44190 WP No. 4854 of 2023 was reserved to the petitioners therein to get their land surveyed to identify the survey number of the remaining 2 guntas of the land by respondent No.3. Therefore, the petitioners approached respondent No.3, however, the same has not been considered. Accordingly, learned counsel appearing for the petitioners seeks interference by this Court. 4. Per contra, Sri. Pradeep J.S., learned counsel appearing for respondent No.7 submitted that, the petitioners herein had filed O.S.No.52/2023, seeking declaratory relief and the said suit came to be dismissed on 24.07.2026. Therefore, respondent No.7 is claiming right over the property based on the registered Sale Deed dated 30.11.1965 and the Rectification Deed dated 09.06.2003. Accordingly, it is submitted that, no interference is called for in this petition and sought for dismissal of the petition. - 6 - HC-KAR CNR: KAHC010099942023 NC: 2026:KHC:44190 WP No. 4854 of 2023 5. Learned High Court Government Pleader appearing for respondent Nos.1 to 3 sought to justify the impugned orders. 6. In the light of the submission made by the learned counsel appearing for the parties, it is evident that respondent No.7 is claiming right over the property based on the registered Sale Deed dated 30.11.1965 and thereafter, as the survey number has been wrongly mentioned as Survey No.2 instead of Survey No.1/11A and the same was rectified vide registered document dated 09.06.2003. 7. In that view of the matter, as the mutation has been effected based on the registered instruments, I am of the view that, no interference is called for in this writ petition. However, it is made clear that, respondent No.1 has dismissed the revision petition on merits. Having regard to the same, respondent No.1 ought not to have directed the petitioners to survey the land by approaching - 7 - HC-KAR CNR: KAHC010099942023 NC: 2026:KHC:44190 WP No. 4854 of 2023 respondent No.3. It is also to be noted that the suit filed by the petitioners in O.S.No.52/2023 is dismissed on 24.07.2026. 8. In that view of the matter, I am of the considered view that, no interference is called for in this writ petition. Accordingly, the Writ Petition is dismissed.
